The Power & Communication Contractors Association (PCCA) applauds the U.S. Senate's rejection of Lauren McFerran's nomination to serve another term as National Labor Relations Board Chair. Announced on December 11, just five days before the deadline, the decision marks the end of her tenure on the board, which has been problematic at best and, at worst, outright unconstitutional.
PCCA members have been contacting their Senators over the last couple weeks to oppose the McFerran renomination, and when PCCA Government Affairs Committee members flew into to Washington, D.C., at the end of November to meet with legislators, the issue was atop their agenda.
McFerran's forced renomination was a blatant political maneuver by the outgoing Biden administration to cement Democratic control of the NLRB until 2026. Her rulings, which included the redefinition of joint employer standards and the promotion of coercive card-check unionization methods, eroded legal clarity and jeopardized long-standing business models. Moving forward, we hope the NLRB can distance itself from McFerran's divisive policies and instead focus on restoring fairness and legality in the business community.
"After years of being burdened with her impractical and unconstitutional policies, it's time for a fresh approach to labor policy," PCCA President & CEO Tim Wagner said. "The Senate's decision to reject McFerran is a significant step in that direction."
